TERMS AND CONDITIONS

This Agreement is effective as of April 9, 2021 and replaces any previous agreement with respect to the subject matter of this Agreement.


This Visa® True Blue® Money PayCard Debit Card Cardholder Agreement (“Agreement") is the agreement between you and Capitol Federal® Savings Bank, with respect to the issuance and use of your Visa True Blue Money PayCard Debit Card and the prepaid Payroll Card Account accessed by the Card. You will be deemed to have accepted the terms of this Agreement if: (a) you have received your Card, (b) you activate your Card, or (c) you use your Card or authorize another person to use your Card. Your responsibility for Transactions with the Card does not depend on whether or not you sign your Card.

Your Card is a prepaid reloadable card that can only be used to access funds in your Payroll Card Account. It cannot be used to access any other account and is not a credit card. In connection with your Payroll Card Account, you are entitled only to any rights or benefits that are contained in this Agreement or available to you under the law.

Please read this Agreement carefully and keep it for future reference. Your Card is the property of the Bank, and we may close your Payroll Card Account at any time without cause or notice. You may not use an expired or cancelled Card.

1. DEFINITIONS.

Capitalized terms used in this Agreement have the meaning set forth in this Definitions section. Other capitalized terms are also defined throughout the Agreement.

"Available Balance" means the balance of funds in your Payroll Card Account, less the amount of any previously authorized Transactions or withdrawals from your Payroll Card Account that are pending plus the amount of any disputed Transactions while the dispute is pending plus the amount of any returns that are credited back to your Payroll Card Account.

"Bank" means Capitol Federal Savings Bank, a federally chartered savings bank headquartered in Topeka, KS, which may also be referred to as “Capitol Federal,” "Issuer,” “we," "our" or "us."

"Business Days" means Monday through Friday, excluding federal holidays.

"Card" means the Visa True Blue Money PayCard Debit Card issued to you by the Payer or the Bank – whether or not such card carries a personalization imprint with your name – or the number printed on the face of the Card.

“Compensation” means the wages, salary, or other compensation or amounts due to you by the Payer that the Payer transfers to the Bank to be credited to your Payroll Card Account.

“Payer” means your employer or another entity with whom you have agreed to receive Compensation by electronic funds transfer to your Payroll Card Account.

“Payroll Card Account” means the prepaid payroll card account accessed by your Card.

"Transaction" means a request by you (a) to withdraw cash using the Card or obtain information about the balance remaining on the Card at an ATM, (b) to purchase or lease goods or services at a third party merchant location (including via the telephone or the Internet) using the Card, which may be authorized or declined by the Bank, (c) to withdraw cash through a cash advance at a financial institution using the Card, or (d) to initiate Account Funding Transactions (“AFTs”) including person-to-person money transfers, account-to-account money transfers, prepaid card reloads, and adding value to a digital wallet.

“Website” means www.visaprepaidprocessing.com/truebluepaycard.

"You" and "your" refer to the person who received the Card for the purpose of receiving Compensation from the Payer and/or the person whose name appears on the face of the Card or to whom the Card is registered and is the person authorized to use it as provided for in this Agreement.

2. GENERAL INFORMATION

Prepaid Payroll Card. Your Card is a prepaid, reloadable payroll debit card linked to your Payroll Card Account and established for the primary purpose of receiving Compensation from the Payer. You may also load additional funds to your Payroll Card Account in accordance with the terms of this Agreement. The Card is not a gift card or award card. In order to obtain your Card, you must have previously agreed with Payer to receive all or a portion of your Compensation by means of electronic funds transfer into the Payroll Card Account accessed by your Card. Payer is not the issuer of the Card and is not responsible for the Card or your use of the Card.

Payer’s Transfer of Funds. The Payer is responsible for transferring funds to the Bank, which the Bank will add to your Payroll Card Account in accordance with the Payer’s instructions. Your Compensation will be available to you for each pay period on or before the regular payday established by the Payer or on another date as directed by the Payer. If your payday or the day on which we receive the funds from the Payer, as applicable, is not a Business Day, the funds will be available to you on the next Business Day. The Bank is not responsible if the Payer delays in providing or fails to provide the funds to be credited to your Payroll Card Account. The Payer may direct the Bank to deduct from your Payroll Card Account any overpayment to you. You hereby authorize the Bank to accept instructions from the Payer to add funds to or deduct funds from your Payroll Card Account, and, in the case of a deduction, return those funds to the Payer. If you have a dispute with the Payer about the amount of your Compensation or the amount that the Payer instructs the Bank to add to or deduct from your Payroll Card Account, you agree to not involve the Bank in that dispute and to resolve that dispute solely with Payer.

Interest. You will not be paid or earn interest on your Payroll Card Account.

Payroll Card Account Ownership. You are the sole owner of your Payroll Card Account. No joint ownership of your Payroll Card Account is permitted. Payer has no ownership interest in your Payroll Card Account.

Authorized User. If you have a personalized Card, you may request that we issue one additional Card to another individual that you designate as an authorized user (“Authorized User”). We will determine in our sole discretion whether to honor such a request. If we honor your request, we will issue a Card in the name of the Authorized User.

The Authorized User shall have full access to the funds available in your Payroll Card Account. The Authorized User will have limited access to information through the Website, including your Payroll Card Account status and balance and the Authorized User’s own transaction history. The Authorized User shall not be an owner of your Payroll Card Account, and shall not be authorized to change the ownership of your Payroll Card Account. You or the Authorized User may cancel the Authorized User’s Card at any time. The Authorized User may load funds onto the Payroll Card Account; however, we shall under no circumstances be liable to the Authorized User for the return of such funds if the Authorized User’s access to the Payroll Card Account is cancelled or terminated. The Authorized User shall be subject to the terms of this Agreement.

Transferability and Assignment. Your Card is for your personal use only. You may not resell, assign, pledge, or otherwise transfer your interest in your Card or your Payroll Card Account.

Fees. Your Payroll Card Account is subject to the fees and other conditions and limitations set forth in Section 15 of this Agreement. Fees will also be disclosed to you in separate Long and Short Form Disclosures. You agree to pay any and all fees as we may, from time to time, impose pursuant to this Agreement. We will deduct any such fees from your Payroll Card Account. All fees disclosed are imposed and retained by us, with the exception of fees charged for loading your Payroll Card Account at ReadyLink locations or using the Ingo App. You may be charged other fees for the use of your Card – for example, a fee or “surcharge” charged by the owner of an ATM for use of the ATM. Such fees are not imposed by us and, therefore, are not specifically disclosed by us.

Card Registration. You must register your Card before you can use it to complete a merchant Transaction. It is also important that you register your Card as soon as possible for FDIC insurance eligibility and other protections. To register your Card, go to www.visaprepaidprocessing.com/truebluepaycard.

Identity Verification. To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account. We will request identifying information about you including your full name, address, date of birth, and social security number or government issued identification number.

FDIC Insurance. Your funds will be held at or transferred to Capitol Federal, an FDIC-insured institution. Once there, your funds are insured with all your other accounts that you hold at the Bank, up to $250,000, by the FDIC in the event Capitol Federal fails, if specific deposit insurance requirements are met and your card is registered. 3. RELOADING YOUR CARD

Reloading Your Card. You may load additional funds to your Payroll Card Account up to the amount of $5,000 at any Capitol Federal Savings Bank office during our regular business hours or by calling customer service at 1-888-822-7333, provided such funds are in U.S. currency (cash) or are transferred from available funds from a Capitol Federal account and your Card is active and in good standing. The total balance on your card may not exceed $10,000. Additional loads of funds to your Payroll Card Account also are permitted at Visa ReadyLink locations, but you may be charged a fee by the participating merchant. You may find Visa ReadyLink locations at http://usa.visa.com/locators/readylink-locations.jsp.

Ingo Money App is also available for mobile check deposit to your Payroll Card Account. More information is available at www.ingomoney.com. All checks are subject to review and approval. All reloading options are detailed on our Website at www.visaprepaidprocessing.com/truebluepaycard.

4. USE OF YOUR CARD AND PIN; TYPES OF TRANSACTIONS

Card Personalization. If you received a temporary card from the Payer, your Card will automatically be upgraded to a personalized card with your name on it after 4 deposits are made to your Payroll Card Account or more than $2,500.00 in aggregate is deposited to your Payroll Card Account, whichever comes first. A personalized card will be mailed to your address within 7-10 days of the upgrade. Your temporary card will be cancelled upon activation of the personalized card.

Use of Your Card and PIN. Your Card and Personal Identification Number ("PIN") are for your use and protection and you agree that you will:
(a) Not disclose your PIN or record it on your Card or otherwise make it available to anyone else;
(b) Use your Card, your PIN and any ATM only as instructed;
(c) Promptly notify us of any loss or theft of your Card or PIN; and
(d) Be liable for the authorized or permitted use of your Card and PIN.

Limits on Use. We may impose limits on Transactions. The maximum permitted cash withdrawal at an ATM is the lesser of $500/day or the Available Balance of the Payroll Card Account (subject to the currency denomination limitations at the ATM), less any fees associated with that Transaction. Some ATM operators have maximum amounts that may be withdrawn at a machine in one transaction. The maximum permitted point-of-sale Transaction at a merchant location is the lesser of $2,500/day or the Available Balance of the Payroll Card Account, less any fees associated with that Transaction. Some merchants limit the amount of cash that may be obtained in connection with a point-of-sale transaction. The maximum permitted cash advance Transaction is the lesser of $10,000/day or the Available Balance of the Payroll Card Account, less any fees associated with that Transaction. The maximum permitted account funding Transaction (AFT) is the lesser of $2,000/day or the Available Balance of the Payroll Card Account, less any fees associated with that Transaction. If these daily limits change, we will give you advance notice if required by law.

When you use your Card at a merchant, the merchant will request a preauthorization for the amount of the Transaction. We will place a hold on the Available Balance of your Payroll Card Account equal to the preauthorization for up to seven days or until the Transaction posts to your Payroll Card Account, whichever occurs first. If the preauthorized amount does not match the amount of the settling Transaction, the hold may not be released until the hold expires.

Note that some self-service pay-at-the-pump gasoline Transactions may be denied if your Available Balance is less than $75 and the merchant does not participate in the partial authorization program. The partial authorization program allows the merchant to request partial authorization for fuel Transactions when your Payroll Card Account’s Available Balance is not sufficient to approve the Transaction in full allowing you to spend the Available Balance rather than declining the Transaction.

If we suspect that irregular, unauthorized or unlawful activity may be involved with your Payroll Card Account, we may "freeze," or place a hold on, the Available Balance pending an investigation of such suspected activity. If we freeze your Payroll Card Account, we will give you any notice required by law.

No Preauthorized Payments. You may not make preauthorized regular payments or transfers from your Payroll Card Account.

Point-Of-Sale Transactions. You may use your Card to purchase goods and services and obtain cash at merchants that accept Visa debit cards. Some Transactions may require use of your PIN. We reserve the right to restrict certain Transactions. If your purchase amount is greater than the remaining Available Balance in your Payroll Card Account, most merchants will permit you to pay the difference with alternative methods.

You do not have the right to stop payment on any point-of-sale Transaction. You agree that we are not responsible for goods or services purchased with your Card, any merchant that refuses to accept your Card, or any other actions by a merchant. You will resolve any merchant dispute directly with the merchant and accept any refund on purchases made using your Card as a credit to your Payroll Card Account.

Cash Access. You may use your Card and PIN to obtain cash or make balance inquiries at any ATM displaying the Visa logo. You may also use your Card to obtain cash at offices of financial institutions that accept Visa cards, including our offices, in a cash advance. You may be charged a fee for a withdrawal or balance inquiry at an ATM, including those displaying the Capitol Federal Savings Bank name and/or logo.

Foreign Transactions. If you use your Card to purchase goods or services or to obtain cash from an ATM in a currency other than U.S. dollars, Visa will convert the charge into a U.S. dollar amount. The currency conversion exchange rate on the processing date may differ from the rate on the Transaction date. The currency conversion exchange rate used by Visa will either be (a) a rate selected by Visa from a range of rates available in wholesale currency markets for the applicable central processing date, which rate may vary from the rate Visa receives, or (b) the government-mandated rate in effect for the applicable central processing date.

In each instance, we will also charge and deduct from the Available Balance a 1% international transaction fee on the U.S. dollar amount of any Transaction that is made in a foreign currency. If you use the Card to purchase goods or services outside the United States, even if you pay in U.S. Dollars, we may charge and deduct from the Account Balance a 1% international transaction fee on the amount of the Transaction.

Negative Balance. Your Payroll Card Account does not include an overdraft feature. Any Transaction exceeding the Available Balance that will create a negative balance on your Payroll Card Account is not permitted. We may decline to authorize any Transaction for which we reasonably believe you have insufficient or unavailable funds at the time the Transaction is authorized to cover the amount of the Transaction. However, if we authorize or settle a Transaction for more than your Available Balance, you agree (a) that we may take the amount of the negative balance from subsequent loads to your Payroll Card Account or (b) to pay us on demand the amount of the negative balance. There are no fees associated with a negative balance.

Legal Transactions. You agree that you will use your Card only for Transactions that are legal. You agree not to use the Card for illegal Transactions or activity, including without limitation Internet gambling Transactions. Display of a Visa or other logo by an on-line merchant does not mean that the Transaction is legal where you conduct it. You agree that we may decline Transactions we believe may be illegal or in violation of applicable network rules. You also agree that if we do not decline the Transaction, we may debit your Payroll Card Account and we are not liable to you if you engage in an illegal Transaction or activities.

5. RIGHT TO RECEIVE DOCUMENTATION OF TRANSACTIONS

Terminal Receipts. You usually can get a receipt at the time you make any Transaction with your Card at an ATM, cash advance, or point-of-sale terminal; however, you may not get a receipt if the amount of the Transaction is $15 or less.

Electronic Statements and Notices. You may obtain information about the amount of money you have remaining in your Payroll Card Account by calling 1-888-8CAPFED (1-888-822-7333). This information, along with a 12-month history of account transactions, is also available online at www.visaprepaidprocessing.com/truebluepaycard.If your account is registered with us, you also have the right to obtain at least 24 months of written history of account transactions by calling 1-844-909-1613, or by writing us at Capitol Federal Savings Bank, 700 S Kansas Avenue, Topeka, KS, 66603. You will not be charged a fee for this information.

6. LEGAL PROCESS AND OUR RIGHT TO SETOFF

Legal Process. Following receipt by us of any legal action (“Legal Process”) such as a lien, attachment, garnishment or other proceeding brought against you or your Payroll Card Account, we may, without notice to you, unless otherwise required by law, withhold transfer of so much of the Available Balance of your Payroll Card Account as may be the subject of such Legal Process, and pay such amount to the court or creditor, in accordance with applicable state or federal law without liability to you for such withholding or payment or for refusal to honor transfers made by you. If we incur any costs or expenses, including but not limited to reasonable attorney fees, in responding to any Legal Process, you will reimburse us for such costs or expenses or we may deduct them from your Available Balance. Any Legal Process brought against you or your Payroll Card Account shall be subject to our right to setoff.

Setoff. If you ever owe us money for any reason as a borrower, guarantor or otherwise, and it becomes due, we have the right under the law called “setoff” to use the money from your Payroll Card Account to pay the debt as well as any costs or expenses incurred by us in enforcing our rights. Any such indebtedness now or hereafter owing to us by you may be charged to your Payroll Card Account. We may exercise this right of setoff at any time, without prior notice to you. We will not be liable to you if our setoff from your account leaves insufficient funds to cover outstanding items. You agree to hold us and our affiliates harmless from any claim arising as a result of the exercise of our right of setoff.

7. YOUR LIABILITY FOR UNAUTHORIZED TRANSACTIONS

Tell us AT ONCE if you believe your Card or your PIN has been lost or stolen, or if you believe that a Transaction has been made without your permission. Telephoning is the best way of keeping your possible losses down. You could lose all the money in your account. If you tell us within two Business Days after you learn of the loss or theft of your Card or your PIN, you can lose no more than $50 if someone used your Card or your PIN without your permission.

If you do NOT tell us within two Business Days after you learn of the loss or theft of your Card or your PIN, and we can prove we could have stopped someone from using your Card or your PIN without your permission if you had told us, you could lose as much as $500.

Also, if your statement, the Website or a telephone inquiry of your Available Balance shows transfers that you did not make, tell us at once. If you do not report unauthorized Transactions to us within 60 days from the earlier of the date you electronically accessed your account, if the error could have been viewed in your electronic history, or the date we sent the FIRST written history on which the error appeared, you may not get back any money you lost after the 60 days if we can prove we could have stopped someone from taking the money if you had told us in time. We may limit the investigation to 120 days from the date the Transaction posted to your Account. If a good reason (such as a long trip or a hospital stay) kept you from telling us, we will extend the time periods.

For purposes of these disclosures, our business days are Monday through Friday. Holidays are not included.

8. BANK'S LIABILITY.

If we do not complete a transfer to or from your Payroll Card Account on time or in the correct amount according to this Agreement, we may be liable for your losses or damages. However, there are some exceptions. We will not be liable, for instance:
(a) If, through no fault of ours, your Available Balance is insufficient to complete the Transaction;
(b) If the ATM where you are making the Transaction does not have enough cash to complete the Transaction;
(c) If the ATM or POS terminal was not working properly and you knew about the breakdown when you started the transaction;
(d) If circumstances beyond our control (such as power outages, equipment failures, fire or flood) prevent the transaction, despite reasonable precautions that we have taken; or
        (e) If your Card or PIN has been reported to be, or suspected of being, lost or stolen, and we have taken action to prevent transactions with your Card or PIN.

We have no liability for our failure to provide an authorization when the failure is a result of an act of God, failure of a public utility, computer or equipment failure, accident, outdated or erroneous data regarding your Available Balance, strike, war, disaster, act of terrorism, failure of communication links or facilities, or other circumstance beyond our control.

EVEN IF LIABILITY IS ESTABLISHED FOR ACTUAL DAMAGES, IN NO EVENT WILL WE BE LIABLE TO YOU FOR SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR PAYROLL CARD ACCOUNT OR YOUR CARD, REGARDLESS OF WHETHER WE MAY HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, UNLESS REQUIRED BY APPLICABLE LAW. The limitations and exclusions in this paragraph shall apply to all claims of every kind, nature and description whether arising from breach of contract, breach of warranty, gross negligence or other tort, and will survive the termination of this Agreement and all of your business with us.

9. ERROR RESOLUTION.

In the case of errors or questions about your Card or Payroll Card Account, telephone us at 1-888-8CAPFED (1-888-822-7333) or write us at Capitol Federal Savings Bank, 700 S. Kansas Ave, Topeka, KS 66603, or email us at banking@capfed.com as soon as you can, if you think an error has occurred in your Payroll Card Account. Disputes may also be filed on the Website at www.visaprepaidprocessing.com/truebluepaycard. We must allow you to report an error until 60 days after the earlier of the date you electronically accessed your account, if the error could have been viewed in your electronic history, or the date we sent the FIRST written history on which the error appeared, but we may limit the investigation to 120 days from the date the Transaction posted to your Account. You may request a written history of your transactions at any time by calling us at 1-844-909-1613 or by writing us at Capitol Federal Savings Bank, 700 S. Kansas Ave, Topeka, KS 66603. You will need to tell us:

(a) Your name and Payroll Card Account Card number.
(b) Why you believe there is an error, and the dollar amount involved.
(c) Approximately when the error took place.

If you tell us orally, we may require that you send us your complaint or question in writing within 10 Business Days.

We will determine whether an error occurred within 10 Business Days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 days to investigate your complaint or question. If we decide to do this, we will credit your Payroll Card Account within 10 Business Days for the amount you think is in error, so that you will have the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within 10 Business Days, we may not credit your account.

For errors involving new accounts, point-of-sale, or foreign-initiated transactions, we may take up to 90 days to investigate your complaint or question. For new accounts, we may take up to 20 Business Days to credit your account for the amount you think is in error.

We will tell you the results within three Business Days after completing our investigation. If we decide that there was no error, we will send you a written explanation.

You may ask for copies of documents that were used in the investigation.

10. PRIVACY POLICY AND DISCLOSURE OF ACCOUNT INFORMATION TO THIRD PARTIES.

You will receive a copy of our Privacy Policy, which generally addresses how we share customer information. You may also view this policy at https://www.capfed.com/privacy-and-security/consumer-privacy-policy.

We will disclose information to third parties about your Payroll Card Account or your Transactions:

(a) Where it is necessary for completing Transactions;
(b) In order to verify the existence and condition of your account for a third party, such as a consumer reporting agency or merchant;
(c) In order to comply with government agency or court orders; or
(d) If you give us your written permission.

You will notify us immediately at Capitol Federal Savings Bank, 700 S Kansas Avenue, Topeka, KS, 66603, if you believe any information we reported to a consumer reporting agency is inaccurate.

We will also automatically submit your Payroll Card Account information to the Visa Prepaid Clearinghouse Service (“PCS”) to assist in fraud prevention measures. PCS is a centralized database that consolidates, tracks, and aggregates information about prepaid card enrollments, loads, unauthorized transaction requests and fraud to improve the fraud detection process. Information obtained from PCS can only be used for fraud investigation purposes. Please contact the PCS Customer Service Department for additional details regarding such information. You will have the opportunity to dispute, if necessary, certain information, and Visa will handle the dispute process for you.

11. AMENDMENTS, EXPIRATION AND TERMINATION.

Amendments. Unless prohibited by applicable law, we may, at any time, change the terms and conditions in this Agreement, including the amount of any fee. We may add new terms and conditions and we may delete or amend existing terms and conditions. We generally send you advance notice of an adverse change. If a change is not adverse to you, however, we may make the change at any time without advanced notice. Amendments will be posted on the Website and we will send notices of changes to your address as it appears in our records, or at the Bank’s option, by providing an email alert to you that the changes have been posted to the Website. If you do not agree with the change, you may cancel your Card and close your Payroll Card Account. However, if you continue to use your Card, you shall be deemed to accept and agree to the change. If we increase the amount of any fee, we will provide advanced notice if required by law.

Card Expiration, Inactivity, and Dormancy. Your Card expires on the date listed on the front of your Card. We may at our sole discretion provide a replacement card or send you the balance in the form of a check. You agree to destroy your Card if it has expired.

Your Payroll Card Account becomes inactive when it has had no activity for more than six months; it will become active again once activity resumes. Your Payroll Card Account becomes dormant when it has had no activity for more than 24 months. If you have an Available Balance remaining in your Payroll Card Account after it has become dormant, we may close your Payroll Card Account and send you the balance in the form of a check.

Our Closure or Suspension of Your Payroll Card Account. To the extent permitted by law, we may close or suspend your Payroll Card Account at any time without notice or liability, including in the event you are no longer entitled to receive Compensation from the Payer or if any agreement between the Bank and the Payer is terminated. If we close your Payroll Card Account and you have an Available Balance remaining in your Payroll Card Account, we may send you the Available Balance in the form of a check following a 14-day account settlement period. You agree to destroy your Card after closure of your Payroll Card Account. Your Payroll Card Account may be suspended in the event of fraudulent or unusual activity or if we are unable to verify your identity. Your Payroll Card Account may be reactivated upon verification of Transactions or by updating missing or incomplete information. You are responsible for negative balances that occur after notice of closure or suspension to the same extent as provided in Section 4 of this Agreement. You are also responsible for making alternative arrangements with the Payer, if applicable, for receiving your Compensation.

Closing Your Payroll Card Account. You may close your Payroll Card Account at any time. If at the time you close your Payroll Card Account all Transactions have cleared and there is no remaining Available Balance, your Card will be cancelled. If there is a remaining Available Balance, you may use your Card to reduce the Available Balance to zero before closing your Payroll Card Account. Alternatively, you can contact us and request that the remaining Available Balance be sent to you by check or transferred to another Capitol Federal account. Once your Payroll Card Account is marked for closure, we will send you a check or transfer the Available Balance following a 14-day account settlement period. You agree to destroy your Card after closure. You are responsible for negative balances that occur after notice of closure to the same extent as provided in Section 4 of this Agreement. You are also responsible for making alternative arrangements with the Payer, if applicable, for receiving your Compensation.

12. UNCLAIMED PROPERTY.


Any remaining unclaimed balance after expiration, cancellation, or other closure of your Payroll Card Account will be reported and remitted as unclaimed property to the appropriate state as required by law. After we turn the funds over to the state, we have no further liability to you for the funds, and you must apply to the appropriate state agency to reclaim your funds.

13. GOVERNING LAW/SEVERABILITY.

This Agreement is governed by Kansas law except to the extent federal law controls. If any term of this Agreement is found by a court of competent jurisdiction to be invalid or unenforceable, it shall be severed from this Agreement and will not affect the validity or enforceability of the remainder of this Agreement.

14. WAIVER. We may waive any of the terms or conditions of this Agreement but any such waiver shall be effective only on that occasion and shall not be viewed as a continuing waiver on any other occasion. We can delay enforcing our rights under this Agreement without losing them.
